The use of this site (the "Site") is subject to these Terms of Use ("Terms"). The Site is owned, managed and operated by Nook ("Nook", "we", "us" or "our"). The loan referral services (the "Services") are provided through the Nook website and app.
By accessing or using this Site, or by availing yourself of the Services, you acknowledge that you have read, understood and agree to these Terms, together with our Privacy Policy, which forms an integral part of these Terms. You must be at least eighteen (18) years old to use the Site. If you are acting on behalf of a company, organisation or other legal entity, you confirm that you have the authority to bind that entity to these Terms.
Scope of services
As a mortgage broker and institutional referrer, Nook matches potential borrowers with our banking partners (each, a "Lender") to help find the most appropriate home loan for their needs. As part of the Services, Nook may:
- provide information about Lenders' loan products, terms, charges and fees, and the documents and information required for an application, and answer questions about them;
- collect the documents and information a Lender may require to assess an application, and submit them to a Lender for processing at your request; and
- assign a dedicated loan consultant to prepare and lodge your application, follow up with the Lender and manage the back-and-forth on your behalf.
Nook does not charge clients a commission or fee for the Services. Using Nook is 100% free for the borrower — the Lender pays Nook a referral consideration once your loan is released. By using the Services, you authorise Nook to make a loan referral on your behalf and acknowledge that Nook may be paid for facilitating that referral.
No guarantee of approval
Nook is an independent mortgage broker, not a Lender, and does not lend money itself. While we apply our expertise carefully, we do not guarantee that any Lender will approve a loan. A loan application is only considered for approval or denial once a completed application, together with all required documents and information, is submitted to a Lender. Nook does not have authority to bind, oblige or commit any Lender, and is not a partner, agent or employee of any Lender. Nook is not a party to any contract you enter into with a Lender, and compliance with your obligations under any loan is your sole responsibility.
When you ask Nook to submit an application and refer you to a Lender, you accept that Lender's own terms, conditions and policies. Please read each Lender's terms carefully, as Nook is not responsible for matters agreed directly between you and a Lender.
Limitations and discretion
Nook may decline to refer an application, or cancel an existing or completed referral, at its sole discretion and without giving reasons. Grounds for declining or cancelling may include, but are not limited to, breach of these Terms, suspected fraud or criminal activity, suspicious activity on the Site, incomplete or misleading information, inappropriate or threatening behaviour, refusal to provide information, regulatory prohibitions, a Lender no longer offering a product, or practical or communication difficulties.
Site content and third-party information
The Site may make available information, data, text, images, sound, graphics, video and other materials ("Content"), including Content provided by third parties such as Lenders or advertisers. Content on the Site is for general information only. Product representations and opinions are those of the third party making them and do not necessarily reflect Nook's views. While we take care to keep information accurate, we do not warrant that all Content — particularly third-party Content — is accurate, complete, current or error-free, and we are not responsible for any errors or omissions.
Your account
To register an account you may need to provide personal information such as your name, email address and mobile number. Only you may use your account, and you agree not to authorise anyone else to use your identity or account. You are responsible for keeping your password and any login credentials safe, and you may not assign or transfer your account to anyone else.
Nook may suspend, deactivate or remove an account, temporarily or permanently, at its sole discretion for reasons including those listed under "Limitations and discretion" above. Removed users may not attempt to use the Site under another name or account.
Third-party links
The Site may contain links to websites operated by third parties. Nook does not control these sites and is not responsible for their content, availability, privacy practices or other activities, and a link does not imply endorsement. Your use of any third-party site is at your own risk.
Acceptable use and intellectual property
Except with our written consent, you agree not to modify, copy, distribute, transmit, display, reproduce, publish, license, create derivative works from, transfer or resell any information, software, products or services obtained through the Site. You also agree not to use the Site or its Content for commercial purposes without our written permission, use automated tools to access, monitor or copy the Site, or take any action that imposes an unreasonable burden on the Site or its infrastructure.
Changes to these Terms
Nook may update these Terms from time to time. Any changes take effect when the updated Terms are posted on the Site, and your continued use of the Site after that means you accept the revised Terms. We encourage you to review this page periodically.
